This study aims to establish considerations on the linguistic-discursive functioning of the brazilian Law nº. 8.069 of July 13, 1990, which constitutes a legal framework that deals with the human rights of children and adolescents in Brazil. To perform the analysis of the established corpus, we performed a re-reading with the aim of identifying the linguistic and discursive elements that indicate the type of text analyzed as a genre of legal discourse, which mobilized determining structures for the association of the statments presented in an organization that exceeds the borders of the phrase (since they are constituted with the specific purpose of acting on the readers, in order to ensure their fulfillment). We emphasize that the discursivity analyzed denotes the presence of modalizers as marks of subjectivity, despite the characteristic of neutrality, impartiality and impersonality of legal documents.
